6. ORAL COMMUNICATIONS AND CONSENT CALENDAR

This agenda item affords members of the public the opportunity to directly address the City Council//Redevelopment Agency on any subject relating to the City Council/Redevelopment Agency which is not on the agenda or any item within the Consent Calendar. If the subject you wish to address is not on the agenda, please understand that the Brown Act (Open Meeting Law) precludes the Council from taking any action at this time. All items within the Consent Calendar are considered to be routine and the City Council//Redevelopment Agency will waive the reading of the Consent Calendar (except the title of any ordinances) and adopt all resolutions and ordinances, and approve other items by one motion and one vote. The total time allocated to this agenda item is within the discretion of the Mayor/Chair, but is generally limited to 15 minutes.

Approve the Contract Documents and award the contract for the 2003-2004 Slurry Seal Project to the lowest responsible bidder, American Asphalt Repair & Resurfacing Co., Inc. of Hayward, California, for their bid of $311,269.90.

Annexation to the Emerald Lake Heights Sewer Maintenance District (ELHSMD) Supplemental Agreement No. 33

Recommendation:
Adopt a resolution approving and authorizing execution of Supplemental Agreement No. 33 with the County of San Mateo, and consenting to the annexation of Assessor’s Parcel No. 068-205-110 (4108 Jefferson Avenue) to the Emerald Lake Heights Sewer Maintenance District (ELHSMD), subject to the following conditions:

1. Property owners pay a Wastewater Treatment Capacity Fee of $715.50.
2. Property owners pay a Sewer System Capital Facilities Fee of $960.00.
3. An Annexation Agreement between the City and County be executed

Adoption of resolutions authorizing the City Clerk and Agency Secretary to accept real property deeds, grants, and easements on behalf of the City and Redevelopment Agency, respectively – City Council and Redevelopment Agency

1. That the City Council adopt the attached resolution authorizing the City Clerk or his/her designee to accept real property deeds, grants, and easements on behalf of the City.

Introduce an ordinance amending the Municipal Code to add Article 27A, adding Article II, Stormwater Treatment Measures and Maintenance Program, which would include the California Regional Water Quality Control Board General Order R2-2003-0023, amending the Countywide NPDES Municipal Stormwater Permit, including requirements for Operations and Maintenance Agreements

Recommendation:
It is recommended that the City Council adopt an ordinance by the affirmative vote of five-sevenths (5/7ths) of all council members appropriating and transferring certain funds for specified purposes in order to conform the budgeted amounts to actual expenditures approved for transactions, which have occurred during fiscal year 2003/2004.
