6. ORAL COMMUNICATIONS AND CONSENT CALENDAR

This agenda item affords members of the public the opportunity to directly address the City Council on any subject relating to the City Council which is not on the agenda or any item within the Consent Calendar. If the subject you wish to address is not on the agenda, please understand that the Brown Act (Open Meeting Law) precludes the Council from taking any action at this time. All items within the Consent Calendar are considered to be routine and the City Council will waive the reading of the Consent Calendar (except the title of any ordinances) and adopt all resolutions and ordinances, and approve other items by one motion and one vote. The total time allocated to this agenda item is within the discretion of the Mayor, but is generally limited to 15 minutes.

Lease agreement with San Mateo County Bay Area Legal Aid to occupy an office suite at 707 Bradford Street – Redevelopment Agency

Recommendation:
That the Agency approve a lease agreement with Bay Area Legal Aid (Baylegal), which allows Baylegal to be a short-term, month-to-month tenant at 707 Bradford Street, and authorizes the Redevelopment Manager to execute the lease agreement.

C.

Authorization to increase construction contract change order value from 10% to 15% for the Route 101/Ralston Avenue Interchange Improvements Project (from $1,243,000 to $1,864,500)

Recommendation:
Authorize the City Manager to execute Contract Change Orders to add contract value for the Route 101/Ralston Avenue Interchange Improvements Project, from 10% to 15% of the original contract value.

Revocable Permit for Use of Herkner Pool by Menlo Masters/Team Sheeper

Recommendation:
Staff recommends that City Council approve by motion the revocable permit with the Menlo Masters/Team Sheeper for the use of Herkner Pool.

Final Acceptance – Fair Oaks Elementary School Sport Field Improvement Project Engineering File No. 803-02

Recommendation:
Accept, by motion, the Fair Oaks Elementary School Sport Field Improvement Project, and authorize the release of bonds and retention per contract obligations.

B.

Final Acceptance – Construction of Improvements for 1250 Jefferson Avenue

Accept, by motion, the construction improvements for 1250 Jefferson Avenue (Whole Foods Market), and release the bonds following the submission of a Maintenance Bond in the amount of $6,600.00, in accordance with paragraph 8 of the Agreement.

A.

Appeal of the Zoning Administrator’s approval of a Use Permit and Architectural Permit at 2325 Euclid Avenue to allow for the installation of a wireless telecommunications facility.

Recommendation:
That the City Council uphold the Zoning Administrator decision and based on a review of the staff report, administrative record and public testimony find that:

1. The placement of the subject facilities, as conditioned by the Use Permit and Architectural Permit, will meet the requirements of Redwood City Zoning Ordinance Article 38, including but not limited to, operation and maintenance; height; setbacks; distance; area; color; and screening.

2. The subject facilities will comply with the radiation requirements established by the Federal Communications Commission (FCC) and that the City is preempted by Federal law from regulating the placement of such facilities that comply with FCC regulations related to radiation.

3. Conditions contained in Use Permit 62-01 and Architectural Permit 63-01 are limited to Verizon, Inc. and do not extend to the subject application.

2. the Agency Board adopt a resolution approving the Disposition and Development Agreement by and between the Redwood City Redevelopment Agency and Peninsula Habitat for Humanity which provides for subsequent transfer of land to Peninsula Habitat for Humanity (Agency)

8. STAFF REPORTS

Memorandum of Understanding between the San Mateo County Historical Association and the City of Redwood City for renovation of the Solari Windmill.

Recommendation:
To approve the Memorandum of Understanding between the San Mateo County Historical Association and the City of Redwood City for renovation of the Solari Windmill including a grant of $30,000 in Capital Improvement Project funds for this project in the 04-05 Budget, together with $2,315.15 in private donations received from community fundraising.

B.

Adoption of a Resolution Confirming City Council Policy with respect to development on Laurel Way

Recommendation:
That the Council adopt the attached resolution confirming their policy with respect to the development of vacant sites on Laurel Way as follows:

1. Determine that the December 18, 2000 staff report and Exhibit A to Resolution 14111 (a map) accurately represent the Council’s policy with respect to the location of the “EIR – No EIR Line;”

2. Adopt the attached Resolution which clearly states the policy as it is presented in the December 18, 2000 staff report and Exhibit A in regards to determining the location of the “EIR – No EIR Line.”
