6. ORAL COMMUNICATIONS AND CONSENT CALENDAR
This agenda item affords members of the public the opportunity
to directly address the City Council on any subject relating
to the City Council which is not on the agenda or any item
within the Consent Calendar. If the subject you wish to
address is not on the agenda, please understand that the
Brown Act (Open Meeting Law) precludes the Council from
taking any action at this time. All items within the Consent
Calendar are considered to be routine and the City Council
will waive the reading of the Consent Calendar (except the
title of any ordinances) and adopt all resolutions and ordinances,
and approve other items by one motion and one vote. The
total time allocated to this agenda item is within the discretion
of the Mayor, but is generally limited to 15 minutes.

7. PUBLIC HEARINGS

Continued Appeal of the Zoning Administrator’s
approval of a Use Permit and Architectural Permit at
2325 Euclid Avenue to allow the installation of a wireless
communications facility

Recommendation:
That the City Council uphold the Zoning Administrator
decision and deny the appeal of Mary Browne and Gerald
Nagel based on a review of the staff reports for the
February 28 and April 25 meetings, the administrative
record and public testimony and find that:
- The placement of the subject facilities, as conditioned
by the Use permit and Architectural Permit, will meet
the requirement of Redwood City Zoning Ordinance Article
38, including but not limited to, operation and maintenance;
height; setbacks; distance; area; color; and screening.
- The subject facilities will comply with the radiation
requirements established by the Federal Communications
Commission (FCC) and that the City is preempted by
Federal law regulating the placement of such facilities
that comply with FCC regulations related to radiation.
- Conditions contained in Use Permit 62-01 and Architectural
Permit 63-01 are limited to Verizon, Inc. and do not
extend to the subject application.
Further, that denial of this appeal be subject to the
preparation, submission, and approval by the City Council
of written findings supporting denial of this appeal.
Said findings shall be submitted to the City Council
at the next regular City Council meeting now calendared
for May 9, 2005.
