6. ORAL COMMUNICATIONS AND CONSENT CALENDAR -
Items on the Consent Calendar are considered to be routine
by the City Council, and will be enacted by one motion and
one vote. The Consent Calendar category is limited to 15 minutes
of comment as determined by the Mayor. If you wish to speak
to items on the Consent Calendar, please complete a speaker's
card and give it to the Deputy City Clerk.
MOTION: Waive reading of the Consent Calendar
except the ordinances by title, adopt the resolutions and
the ordinances, and approve other items.

Appeal of Zoning Administrator’s Approval
of a Use Permit for Woodside Hills Christian Academy
at 2323/2325 Euclid Avenue (Public Hearing closed at
the July 13, 2009 City Council Meeting).

Recommendation:
Deny the appeal and modify the Zoning Administrator’s
decision, thereby altering student capacity of Woodside
Hills Christian Academy by confirming the alternative
language provided in the Revised Notice of Official
Action.

2009 – 2010 Cost Shared Sidewalk Repair Program.

Recommendation:
Approve by motion the contract documents, accept the
bid, and award the contract for the 2009-2010 Cost Shared
Sidewalk Repair Program to SpenCon Construction Inc.,
of Foster City, CA, for the amount of $241,025 and authorize
the City Manager to increase the contract amount, if
necessary, up to 10% of the amount awarded, and reject
all other bids.

Award of Contract – 2008-2009 Street Overlay
Project (Jefferson Avenue and Roosevelt Avenue).

Recommendation:
Approve, by motion, the contract documents and award
the contract 2008-2009 Street Overlay Project (Jefferson
Avenue and Roosevelt Avenue) to G. Bortolotto &
Co., Inc. of San Carlos, for their responsive and responsible
low bid of $578,096.39 and authorize the City Manager
to increase the contract amount, if necessary, up to
10% of the amount awarded.

Project.

to 10% if necessary.

6.2 Section – Resolution

Emergency Generator Retrofit at Police Facility.

Recommendation:
1. Authorize, by resolution, amendment of the Fiscal
Year 2009/2010 Capital Improvement Program to approve
and provide appropriation in the amount of $65,000.00
for immediate work to retrofit the emergency generator
at the Police Facility.
RESOLUTION AMENDING THE 2009-10 CAPITAL IMPROVEMENT
PROGRAM BUDGET TO FUND A $65,0000 EMERGENCY OPERATIONS
CENTER GENERATOR RETROFIT
2. Suspend, by motion, the bidding and purchasing requirements
of Chapter 2, Article VII of the Municipal Code to allow
agreement with Cummins West for the work to retrofit
the emergency generator in the amount of $37,343.70,
and TEC Accutite for the work to decommission, remove,
and dispose of the existing underground fuel tank in
the amount of $15,750.00 based on the facts and findings
set forth in the staff report.
3. Approve, by motion, agreements with Cummins West
in the amount of $37,343.70, and TEC Accutite in the
amount of $15,750.00 and authorize the City Manager
to execute the agreements and increase the agreement
amount, if necessary, up to 10%.

Deny the appeal by motion, thereby upholding the decision
of the Zoning Administrator, with revised conditions
