4. APPROVAL OF MINUTES

A. M/S Hartnett/Ira to Approve the Minutes of the last Regular Meeting of October 16, 2000 and approve the Minutes of the last Closed Session of October 23, 2000 as submitted.

The motion passed by a unanimous voice vote.

6. GENERAL

A. Revocable Permit for Use of Agency Owned Land at El Camino Real and Vera Avenues:

Planning and Redevelopment Manager Church explained the permit request for temporary staging of equipment for construction of the Irvine Apartment Communities portion of the Franklin Street Project.

Recommendation: Approve and Authorize the Grant of Revocable Permit

M/S Hartnett/Pierce to adopt RESOLUTION RD-00-57 APPROVING AND AUTHORIZING EXECUTION OF GRANT OF REVOCABLE PERMIT/CORNER OF VERA AND EL CAMINO REAL (Devcon Construction. Inc.).

The motion included direction to place a diagram or sign referencing the project and passed by a unanimous roll call vote.

B. Third Amendment of Disposition and Development Agreement (DDA) for Franklin Street Project - Shea Homes;

Planning and Redevelopment Manager Church explained that on September 13, 1999 the Redevelopment Agency entered into a DDA with Shea Homes for approximately 300 housing units on the area south of Jefferson Avenue between El Camino Real and the railroad tracks. In May of 2000, an extension was approved until November 20, 2000. A further extension is requested up until March 20, 2001 for refining of business terms and completion of design review of the amended plan.

Public Coment

Ted Hannig stated he had originally opposed the extension and that the issue is that there are developers that could move the project along further than has occurred in the past.

M/S Hartnett/Ira to extend the Exclusive Right to Negotiate for only a period of 60 days from November 20. The extension is to be conditioned on that by the close of business on November 20, the City receives a letter that outlines each of the issues that the project proponent considers need to be resolved or agreed upon and that the list include issues that staff will bring to the attention of the project proponent as well as those the proponent already has in mind. Secondly, that the extension be conditioned upon a waiver by the project proponent of any claims that it has, may have or could have arising from the entire process through the date of the extension.

AND

Adopt RESOLUTION RD 00-58 OF THE REDEVELOPMENT AGENCY OF THE CITY OF REDWOOD CITY APPROVING AND AUTHORIZING EXECUTION OF AGREEMENT OF THE THIRD AMENDMENT OF THE DISPOSITION AND DEVELOPMENT AGREEMENT WITH SHEA HOMES LIMITED PARTNERSHIP FOR THE FRANKLIN STREET PROJECT;

The motion passed by a unanimous roll call vote.
