4. APPROVAL OF MINUTES - (301)

A. M/S Ruskin/Pierce to Approve the Minutes of the last meeting of August 5, 2002;
The motion passed by a unanimous voice vote. RD MINUTE ORDER 02-18

5. CONSENT - None

7:33 p.m. - Vice Chair Ira left the dais due to a conflict of interest

6. GENERAL

A. Downtown Retail-Cinema Project - Selection of Consultant to Provide Land Acquisition and Other Related Real Estate Services; Authorization to include the Law Offices of Herman H. Fitzgerald on the Redevelopment Agency eminent domain attorney panel; (405)

Economic Development Coordinator Webb stated that the agreement with Cutler & Associates and Herman H. Fitzgerald is funded by the developer.

M/S Jordan/Hartnett to extend the meeting to 11:40 p.m. The motion passed by a unanimous voice vote.

M/S Howard/Pierce to:
Approve the agreement with Cutler & Associates to provide consulting services for the Downtown Retail-Cinema Project with a budget not-to-exceed $337,000 and authorize the Agency Executive Director to execute the agreement. The services will include property valuation, negotiations, fixtures and equipment appraisals, tenant acquisition, loss of goodwill procedures, escrow coordination, relocation coordination, and title clearance for the project.

Authorize inclusion of the Law Offices of Herman H. Fitzgerald on the Redevelopment Agency eminent domain attorney panel. Approve the agreement with the Law Offices of Herman H. Fitzgerald to provide eminent domain counsel services for the Downtown Retail-Cinema Project and authorize the Agency General Counsel to execute the agreement.

The motion passed by a unanimous voice vote by those present with Vice Chair Ira abstaining. RD MINUTE ORDER 02-19

M/S Ruskin/Howard to adjourn the meeting. The motion passed by a unanimous voice vote by those present.
