After the City Council adopted the Downtown Precise Plan in 2007, a property owner filed a lawsuit claiming that the Plan’s environmental impact report (EIR) did not adequately address certain issues (future taller buildings casting shadows on other properties; the protection of historic structures). The court agreed, finding several aspects of the EIR to be legally inadequate. In the best interest of the community, rather than engage in further lengthy and expensive litigation the City Council decided to set aside the Plan and its EIR. The Council directed staff to prepare a new Downtown Precise Plan and new EIR that address the court's issues.
